Problem with forwarding from CIS to NVC - HELP!!

My I-140 was approved 12/15/2004 by the CIS and the approval notice said that the case will now be forwarded to the NVC.

Three months later and NVC still had not received the case, so I contacted NVC and they said that I need to request CIS to re-forward the case to the NVC. (Timeline 3/15/2005)

My attorney requested the CIS to reforward the case and according to her she got an "email" from CIS on 4/11/2005 that my case has been re-forwarded to the NVC

Its been more than a month since then (5/17/2005) and still NVC's automated message says "We have no record of your case number".

Please help me. What do I do now. This was supposed to be a faster route compared to 485. It definitely doesnt appear that way to me.

Is there anything I can do ?????

My I-140 was approved on 11/2004. But, they (CSC) didn't send my case to NVC for 3 months. And, my lawyer sent a letter to CSC to forward my case to NVC. But, after one month, their reply is " just waiting until your case will be forwarded". And, I wrote a mail to Senator to help my case and waited one month more. I got a letter from senator after almost 4 weeks later, but said "it'll take for 6~8weeks to check my case". So, I didn't see any hope my case to transfer to NVC. Now, I just filed my case to I-485.

If you have a time and aren't bad situation, you can wait. But, it might be "waste your precious time", too. Judge by yourself, and good luck!

CSC is NOTORIOUS in not sending approved cases to NVC.They delayed sending my case by about 5 months.

Lawyers will NOT do anything.

Contact your local senator and get things moving.

Check my other posts and you will get a very good idea about this topic.
 
Lemme just echo everyone else. Your local (i.e. United States, not state level) congressman or Senator's office can be helpful. Actually, if you haven't some contact with any congressperson, local or not, their office can help. Best of luck!

Since you are in California, you have only 2 congresspersons to contact.
I must warn you that their offices are flooded with requests from all over California.You must send your request to them as early as possible as they themselves take a longer time.

Check this link and you can decide/choose which congressperson you wish to contact:

Another alternative is that even though not a top-shot congress person, you may want to contact your local (covering your Zip Code)who MAY do something faster.

In that case, the congress person will not help you if you contact them.

Your HR department has to write them the request letter.

True, but the Senate Members are more powerful and have much more influence than smaller congress men.

So,contacting a Senate Member helps more.

Nevertheless, you can still contact a local congressperson and see if they can help.
 
Here is my experience

I was in the same boat. USCIS said they sent the case while NVC said they never received it. I had to wait for 3 months since the receipt notice said that. Once 3 months were over, I contacted the senator's office (WA state) and faxed them my case details (Disclosure form from senator's website, I-140 receipt, petition , cover letter requesting assistance). I initially talked to them over the phone pleading my case. They were extremely helpful (blew my mind away). They called me back within 3 weeks saying that USCIS sent the file to Williamsburg, VA (Federal processing center, I guess this may be for AOS) and not to NVC. It then took another 4-5 weeks before my case appeared at NVC. In all, total loss of 5 months !!! USCIS will not respond to the petitioner/atty or anyone except to the Senator's queries.
