Problem with desi employer

Dear Gurus,

I am changing job under AC21. I notified my desi employer about the job change and as usual they started their job as everyone knows here.
I thought they will not pay me for the rest of the period. This time they paid as they didnt have enuf time to hold my salary. But they are not sending me the Salary Slips. I still have to get two more pay checks for which I think they will not even pay me.
But in case if they pay (which i think is a remote chance) and not sending the pay slips, how do I claim the payslips for the last 2 or 3 pay periods?
They already are not attending my phone calls, and will never reply to my emails even. They clearly said that they will not support in any way when I informed of my job change.
I did google on reporting the non-payment of salary and got the website links of department of labor and the state workforce commision. They do have a specific form to notify this kind of issues and an attorney from DOL will investigate the case (as specified in the website).
But I do not know how do I obtain the payslips in case they pay me but do not send the payslips? Should I request from ADP?

Please advise.

File a complaint with department of labor of your state.

Not paying is a serious issues irrespective of immigration issues.

Based on his statement, the employer PAID him but not sending the Salary Slips. There is no such law to require employer to send Salary Slips. As long as they PAID that is good enough right (they could do direct deposit and not sending any salary slips or just send a company check)?

You are thinking too much !!!

Your employer may not uphold your salary as they will be in trouble for doing that. Salary slips will not harm you. They will also send you W2 at the end of the year. BUT

Why do you have to leave with bad terms with them. I would strongly advise you to please do your best to try to make up things .. You never know at what stage of Green Card you need them. Slavery is not yet gone from this country ... it has changed its shape.

Good Luck

I would suggest you stay on good terms with your employer.U never know when u might need them till you dont get your gc.Since the issue is all about payslips and not money it shouldnt be a big deal.

I like these words...It is well said and true...

....Slavery is not yet gone from this country ... it has changed its shape....

But there are times when we can not maintain good terms with the employer when we leave.. espefcally small desi companies... I noticed on many occations that these small desi outfits/persons just seek loopholes in law and law enforcement for immigrants is just myth here in USA. My questions is How far the law is implemented seriously. For example there is a law that a H1B employee should be paid even when he is on bench. why many victims just do not complain because it hurts the employee most in most of the cases....may be in a different way... Governament or USCIS rarely verify and implement these rules. Employees often do not wish to be in the middle of status, legal issues or battles and that is the catch point to be exploited by all...
