Problem with Birth Certificate

I have a birth certificate from India bearing my original date of birth.
All other school records and passport have a different date of birth.
Now for applying I-140/I-485 I need to produce the birth certificate.

Unfortunately my lawyer is not very co-operative and he just asks me to get the records changed. (which is not an easy task).

What are my options now ?
Has anyone else faced this problem ?
Pls advice.

No,

You need to change the birth certificate, other wise you will get RFE in final stages, which is very pain. You file 140 and get changed the birth certificate in the mean time

Yes Raghuc is right..eventually u will have to change the birth certificate..so do it now..or else u will get the RFE...

You know that u can also get an affidavit from 2 people and non-availabilty from the Muncipal office...instead of birth certificate(can get more info on the net or in this forum also)

In my case I have the birth certificate and I cannot get the non-availability from the municipal office. Will the Indian Embassy in DC provide birth certificates?? Do you know any other alternatives?
 
I heard that EMbassy Provided BirthCertificates does not work...I am not 100 percent sure.

(As a matter of fact i am trying to get the non-availability certificate myself which is in process .so keep me in loop if u come to know anything)

bIRTH CERTIFICATES issued by embassy is not valid. I have taken one from Chicago. It says that " as per in the passport blah blah.

So it is not authenticate.

If you are born before 1972 then birth registration is not madatory, then you can get non availability.

If you are born later to it then you have get it.

If you have already taken birth certificate, then you can also get second one .this is a kind of tricky one
starting from the begining. Send a copy of your passport to india and dont tell that you have alreDY taken one.

Then they will register again and search all the registers at that day and Birth certificate is issued.

If you feel, it is not possible, then request for correction in the original certificate.
 
Non-Availability certificate

If you have a birth certificate that has incorrect information, then go to your local municipal office show your school, passport etc and ask them to issue a birth certificate. They will search their records and tell you that this birth was not registered. Then ask them to issue non-availability certificate.

Either way you need a BC with correct details or non-availabilty with 2 affidavits.

This is just my opinion, as always consult an attorney.
