Probably Important PERM (EB2 or EB-2) related info

I will not write any detail analysis but if you are interested in EB-2 please read on.
There has been a lot of confusion about who can apply under EB-2 and who can't, I had discussions with several experts in the field and the answer seems to be on Page 53 to 59 (Appendix A) in conjuction with Yates memorandun on EB-2 (www.immigration-law.com). Any occupation in appendix A that has education and training category of 4 or below are eligible for EB-2.
Also, there has been a big hype about business necessity letter . Well, first the likely hood of getting Businss neccessity letter for education and training category of 4 or below is small as it would be a normal requirement. Second, if you need to show business necessity what the big deal as long as your rational is a sane one.
Now, if you are a software engineer employed by a small company, I think you can still show that that you are computer/information system manager or Management Analyst who render consultancy services to other companies.
