Private Tutions Pay-check....

Hi,

Can a school teacher working o H-1B accept tutoring fees from students either directly from the student OR via her employer(the school) i.e. the student pays the schools which in turn pays the H-1b Employee

is there any legal or tax issues/implications for the Employer or the H-1B employee.

Any insight will be appreciated!

Would not recommend receiving any paychecks/monetary reimbursements other than your H-1B employer, and that too only under the classification or job description for which the LCA was obtained. H-1B holders are only allowed to earn income from their H-1B sponsor ( private investments, gains from selling property etc. dont count)

There was a situation where a person in H-1B status was charging money as a camera hobbyist which the INS discovered (by accident) at the POE, and was deported immediately as having violated H-1 status.

Just my 2c, best to contact a lawyer.

Any ideas for the same scenario if you are on EAD status awaiting your 485/GC approval.
 
No problem if you are on EAD but be sure you have AP to travel since as soon as you work for an employer which is not compatable with your H-1 status you will be in Adjusting status and should have AP to travel.
