My friend's Labor Cert was applied but the employer did not pursue it further..... The friend got a new job and new employer is willing to apply for labor cert. I want to know if the friend can retain the priority date from the old case?
No, your friend is not entitled to port the priority date solely on the basis of LC. Your friend's employer must get the LC and I-140 approved (and later disclose all of the above) to make the PD portable.
