My wife came to US on V-1 visa, Her V visa shows Annotation: EAC99194XXXXX, F2A, priority date: 5/21/1999.
I filed I-130 for my wife on 05/21/99. And received an I-130 transfer notice from Vermont service center (9/15/03) mentioned, “preliminary processing has been completed and it has been transferred to INS Baltimore office. That office will notify you when they schedule an interview on the application or petition”. After 5 years waiting the I-130 still pending. Can I just filing I-485 (base on the priority date show on her visa) without I-130 approval? Please Advise.
