USCIS has released the press report. Pls see Q NO 15.

""How long will aliens have to wait for their employment-based applications to be adjudicated?

A15. Applicants should monitor the State Department’s visa bulletin to determine whether a visa number is available based upon their individual priority dates. There are annual statutory limitations, thus some aliens may have to wait a significant period of time, perhaps years, before visa numbers become available.

Does this Q means that the 485 applications are going to be processed based on the priority date and not based on the receipt date? And hence Priority date wins ? Thats wonderful news for older pd people.

PD always wins, except in some lucky situations such as the VB once again becoming current in a particular month. Some with PDs of 2004 and 2005 have gotten their GCs in early and mid July 2007.

I hope USCIS fixes the problem of RD getting preference over PD from now on. I guess some body needs to file a lawsuit against USCIS making the EB current in future VBs for retrogressed countries, especially without a change in law on country-wise limits.

I agree with you. What is the point to wait until my PD becomes current to file when some one has a late PD but can get a RD way before those earliest PD and getting their approval. If this is a true FIFO queue?

Why not we all can file but only work/approval on those case with a PD Current?
