Priority date vs. approved I485

Just read from some lawyer's news letter that even if the I-485 is approved and stamped, if you do not get the card before 1/1/05, and your priority date is after the posted date(2/2002), you can not get the card until your priority date becomes current. Is that true? anybody please verify.

This can not be possible.Since my case was approved on 12/13/2004 and the message changed for my daughter that we order for new card since she is minor. That means they will send for us(primary) after stamping.Please do not post such BS news.
 
The visa number is issued at passport stamping from E30-E39 categories for all EB3 primary and dependent's applicants. The 2005 visa bulletin limits the use of the E30-E39 visas for anyone with PR of 1/1/2002 after January'2005. If the I485 is approved but the passport hasn't been stamped by that time it may be difficult to get the passport stamped (and get the plastic card) if visa numbers from E30-E39 categories are not available.
This is just my opinion...

If the passport is stamped there should be nothing to stop you from getting the plastic card.
 
A visa number is automatically issued OR you are guranteed of visa moment 485 is approved for AOS or during CP.
Passport stamping is just a formality.Experts pls comment, if i am wrong.

I read a post here from TheRealCanadian that said that he witnessed the process of issuing the visa number to him at the end of his interview (which is normally his PS too). My own passport has "E37" note on it on top of the stamp.
This makes me think that the number is assigned only when you show up in the INS officer and apply for the plastic card.
Like I said I may be wrong about it.

If there is an interview then the IIO will request state dept or thier database for an immigrant visa. In this case AOS (485 approval) is done during interview and which is called for.
But for those who got their approval directly from service center ,should have no worries for PP stamping. Adjudicating officer took care of the visa category allocations/quota during the approval.EB3 retrogression shouldn't be a stumbling block for stamping.

Read your approval notice minutely and then it will make sense.

Who ever started this thread was not in his senses. Scaring people without varification without looking at the general trend is bullshit.
 
If someone is called for interview that means case is not approved. So he is correct that he got visa number when he got approval at the interview.

For cases approved by USCIS Service center, visa number is taken out from quota as soon as they approve the case. You will see visa category like (E26 or E36 etc.) on your I-485 approval notice.

Sorry guys. I never meant to post any bad message. I was confused too.
Please kindly disregard it, I chose not to trust the lawyer's newsletter as well.
