Priority Date relevance to GC approval

My husband and I received I-485 approval letters asking us to make an appointment for Biometrics. We did our biometrics and our online status now says card ordered - GREAT!

However, our lawyers have informed us of the following, 'your priority date is not current. After looking at everything in the file, I have to conclude that the approval notice is an anomaly, and want to warn you that while the application may have been "approved," your green card may not actually be available until your priority date is reached, which could be a while.
Your priority date is 6/16/03; the government is currently issuing immigrant visas [green cards] to people with priority dates earlier than 4/22/01. So, as your priority date is not "current" we are mystified why your adjustment application has been approved.'

Has anyone experienced anything similar and have any advice or information to offer?
 
Congratulations! I heard similar case happened in TSC. That is an EB2.
Please tell us more details about your case. It may give us some hope?!

Mother country - Canada

The approval actually occured in Sept of 2005 but the service center wouldn't let us do our biometrics until we tried to go and get our passports stamped. Instead of the stamp they sent us back to the service center for biometrics and the latest being the card is on order.

My husband and I received our cards. Just my daughter is outstanding now. :p
 
Congrats krsnts! How old is your daughter? I have a similar case too. The card/approval for my daughter has not arrived as well and it has been a month now. :confused:
 
My daughter is 6. My husband and I received approval around Sept 2005. She is still outstanding. She was called in for biometrics around Jan 2005 when my husband and I were called in for fingerprints. Not sure how or why she had biometrics so early. We have put an inquiry in for her case. It has recently been sent to the Phoenix district office. I am waiting for advice from the lawyers on what to do now.

Congratulations. When you say your mother country is canada, I think you do not come under retro country if you are not EB3. If you are EB1 or EB2 you should be fine.
 
Yes. I think you are correct. That is what I am thinking. The confusion is that my lawyers told me I was EB3 category. We are just happy to get our cards. Once my daughter gets hers we can't wait to put this behind us. Thanks for the post!

My daughter is 15 and she had her biometrics early in Dec 05 but up to now, still no approval. I have put in an inquiry for her in mid January and they say her FP and Name Check have been cleared. Just wondering what's taking so long for the approval considering that she is just a derivative beneficiary and the principal applicant has been approved.
 
Good luck to you. We have also verified that they are not waiting on us for anything and all looks fine. We were told that they suspected file seperation but now that her file is found ????? I will update when I get any more infomation.
