Priority Date Question

Hi All,
I had filed a Labor in Jun2001 and which got approved in May2003. But i left the company even after the labor was approved because the cheap attitude of the small desi company was getting unbearable. I did my fresh labor immediately after that, and concurrently filed 140/485 last year. My question is how can i use the Priority date of the previous labor which is Jun2001, what is the procedure to do that, i have the reciept of the first filed labor.
Any help would be of greatly appreciated.
Thanks.

Hi pd_2001,
I think the priority date of the old labour can only be used if 140/485 was filed based of that. Now since your I-140 and I-485 was filed based on new labour but since there was never I-140/485 filed based on your old labour you can't use the old priority date. Now this is just my thought, the gurus in this forum can shed more light.

I have been told that if you file labor once you maintain your Priority Date, so even if you don't use it to file 140/485 (as you had to change company for whatever reason) still you can use the PD of that old one. As i have the PD on the reciept of that first labor and also the approval email is there from the law office. So i want to confirm the same information and also the procedure to do it, do we have to submit the reciept copy of first labor??
Gurus please shed some light.

Ur PD will be mentioned in the 140 approval notice - it will be the date on which the labor was filied - which brought about the 140 approval.

If u want the earliest PD off Ur old labor -- file for 140 based off that.

Hope that helps

Thanks very much ebhola.
So now if i change employer now after 1 and 1/2 years of filing 140/485 concurrent and after 6 months of 140 approval, what are the chances that employer can create any problem as they don't want us to leave the company. I mean if they can revoke 140 or any harm to 485 etc.
Thanks in advance.
