Priority Date porting - Question - Help!

Please read my details below and give your inputs.


I have my labor approved in RIR/EB3 with a priority date of Oct 2002 with company A. Filed my I 140 and responded to an RFE (Ability to Pay) a year back and still waiting for updates on that. However meanwhile, based on the pending I 140 I've changed my H1B to company B and got 1 year extension until Oct2007. (I am actally in end of 7 th year H1B with company A). If I apply for a new labor under PERM EB2 thru company B and get my I 140 under premium processing, can I port my priority date of Oct 2002 to the new approved I 140?

If your first I-140 got approved and your first company didn't revoke your application after you transfer to the second company, then you can use the first labor's priority date.
