Priority Date from pervious approval

I have already cleared the I140 stage in EB-3 Category. I want to apply under EB-2 Category from the same company.

In this case, can I use the old PD (Priority Date) from my EB-3 Category?

One of my friends told me that if you have to apply for GC from scratch (from labor) then one can not use the priority dates form old approval(s) according to the new regulations from BCIS.

Any help/information will be appreciated.

You have to apply new labor and then I-140. then while filing 485, you can use old 140 approval for priority date.

I would not advise doing this through same company because you have to create minimum 50% different job description which will question your past experience.

How can you can file Under Eb2 with same employer.I have been told that Experience doesn't count if you work with same employer..and you can't file under EB2.

Experience doesn't count if your job description is more than 50% same.

I have Master Degree from US, even then it is not safe to appy under EB-2 Category.
