Hi Guys,

I am confused here and need some help.

My I-140 AD 6/2003.
My I-485 RD - 05/13/2003 (EB2 / RIR)
I was laied off in May 2004.
Employer revoked I-140 and got NOID.
Filed Ac-21 in July 2004.
Received the initial response on the Ac-21 case that they are not sending it to the Washington office and will decide in TSC.
After that I received my second FP notice in Feb 2005 and done that in March 2005.

Today the I-485 processing date update shows that they have passed 05/20/2003.

What should I understand with that?

Is my case in the queue for I-485 or AC -21 .
Even for Ac-21 (For I-290 A) they say that the processing time should not be more then 6 months but for me it's going to be about 12 months and I don't have any status on my both the cases?

I am confused and worried.

Please help me ..

thank you in advance..

Sam

indiansam,

If you replied to your NOID ( Notice of Intent to deny) within 30 days or whatever time frame they gave, you should be ok. I am assuming that you have a similar job as your earlier one. if the current processing date passed your receipt date you can call them up and ask them about the status of your case.

That's what I am thinking of doing but it passed just 2 days ago so I want to give them some time.
Also I want to know if anybody else have come across such situations where they have filed AC21 and their I-485 Priority dates have already been passed and not received decision or taken longer to receive decision.

if so, how much time does it takes to process such case after the priority date is passed.

thank you for your response.

If you have received the NOID why did you send I-290? Noid is some thing similar RFE. There is no seperate AC-21 line. It is in the I-485 line. What is Priority date?

Fax an inquiry after 30 days passed.
