Priority Date Confusion

Hi All,
Can anyone please let me know which is the Priority date being considered . I am EB3 - India .My Lawyer told me that Priority date is date on which the Labor was filed. but today I talked to an officer in USCIS and they told me that Priority date is the date on which 1-140 is filed. Now I am totally confused.
Is it the 1-140 Date or Labor Filing date that I should look for to be current.

I would really appreciate any response regarding this.
 
The Priority Date (PD) is the date when the labor was filed. You can see this PD mentioned in your I-140 approval notice.

The PD is the date your labor was filed. The PD can be located on your 140 approval notice. Please do not go by what a USCIS Service Center rep tells you on the phone. They usually have no idea about anything remotely related to immigration and their job is to get you of the phone as fast as possible. I have had way to many interesting and ridiculous conversations and updates from them over the years. I was finally advised by my lawyer to not call them at all.

Thanks a lot Saras. I am relieved . My Priority date is Sept -2001, India , EB3. I was worried If its 1-140 date then it would move forward .
 
Hi,
I checked the I-140 approval & there is no way of indicating the PD of when the labor applied.But there is a receipt date & priority date for I-140 approval.

Also i did talked to my lawyer & he mentioned that while applying for AOS,they will send ETA-750 approved form as well as I-140.Based on that the PD will be established.
