Priority date, confused!

my husband and I sent his I-130 in april 2001, Everywhere That I could find information about it, said it had to be postmarked by april 30th 2001, not RECEIVED, but postmarked.
July 21st 2001 we received approval of I-130 with a priority date of may 1st,
Fast forward a few years. We finally hired a immigration lawyer here in oregon, it was entirely way to confusing to do this ourselves, our lawyers assistant is telling us that the I-130 needed to be received by april 30th not postmarked.
Now were faced with my husband having to go to mexico for up to 6 months to finish paperwork etc etc.
Is there any way around this?
