Priority date and the mysterious background check

My I485 was sent to VSC last May, however, nothing happened after they confirm receiving my fingerprint.

When I called earlier, they said due to Priority date, they won't even touch my case, then, when I called a little bit later, they claimed they can do nothing but wait for result of background check -- only thing I can do, as suggested by them, is to write to congressman...

The question is... when did they submit the background check thing? they sent it immediately after receiving my I485 or waited after priority date is current for my case -- It is not current from their bulletin, right?

weird thing is there is about 20% case like me approved... what are those lucky guys have to get such speedy service?

your security/name/backgrd checks shd have gone out last june right after your FP, when visa numbers were available.

thanks for your reply

I do hope they did that, but I first called early this year and one lady told me they can do nothing about it since priority date, the answer changed to background check issue after two or three month.

And since when USCIS started to do thing as it should be ?

leohawk: my situation is the same. From BOS I got answer " all checks cleared and extended review". From VSC I got "activilly processing this case - additional review" and to wait 6 mo b4 inquiry again. What I know is that there are so many cases like ours. 15 k just from BOS. A bunch more from NYC and WDC. We still don`t see many approvals from VSC.

Had the JERKs in USCIS/FBI/CIA, etc have even 1% of the efficiency of commerical credit report companies, or credit card comapnies, they should have processed all the cases already...

Their job should be in dealing with the so called "illegal immigrants", not those who have documented entry, documented work experience, etc.
