I have a question.
I am the primary applicant of a I 485 application and my application was approved in June 05, but my wife's (filed as dependent) is not. Her application is supposedly stuck in security checks. As of this momnet, it looks like she will not make the Oct 1st deadline for retrogression (PD is Jan 2003).
She is on an H1 and was never on H4. Once retrogression sets in, and for some reason say she either has to quit her job, or takes up a part time job on EAD, will she be considered out of status ?
If yes, what can be done to avoid this situation ?
If no, and she is still considered in legal status, can she travel on AP ? (She has both EAD and AP).
