I need help with my friend's case. His H1b with previous employer (his relative's company) expired 1 month ago, his current H1B application (with another company) got declined because his lawyer did not submit his labor certification paperwork on time, the lawyer later apealled the decision, however the case is still pending. and it's been months now.
Is he out of status?
Can he refile through this company? Does that mean he has to go back to his home country india and have visa stamped?
Or should he just wait for USCIS's final decision?
By the way, i thin his relative (former h1b sponsor) would mind sponsoring his H1B again even my friend is not working for him.
