prevailing wages

Hi guys, folks..please anyone answer to me.. i am working in oregon state as a SAP systems analyst, permanent position and i am being paid 62K + bonus per annum some say that this wage is less for me to apply labor cert.. i dont know what to do since i came to this country a year back and i dont know info reg. this..Is my salary is less for me to apply for LC.
 
I don't know where you are in Oregon but it looks possible to me. You are close to the prevailing wage for Level 2 and way over level 1 for everywhere in Oregon that I checkedI looked. I'm almost certain that it is workable. Portland lists a wage for a Level 2 Systems Analyst at $66,768/year.
 
Can anyone plase clarify:

Do I need to submit my latest paystubs along with the labor application? if not,how will SESA knows about my salary and how will they determine that my salary is as per the prevailing wage rate rules?

I'm applying my labor through a different employer hoping to join later.Since GC is for future employment,can't we simply put higher salary in the applicaiton and file?

Wage you mention in the ETA 750A

Wage you specify in ETA-750A is what the company is willing to pay after you get your GC (going to pay the person who will be recruited for the position advertised), it is not not what you are getting now. So it can be a higher figure. Only thing you should make sure is it is above or equal to the prevailing wage. For prevailing wage check DOLs website.
 
hello Mr.Jim thanks for your immediate reply. As you said i will fall in level 2 category. i have Masters degree in Engg. + 7 yrs of experience in that related field. i saw the DOT prevailing wages list , it says for portland-vancouver area the wage is aroung 66K for computer systems analyst..Is that the minimum wage i should be paid by the company or it is the maximun amt be paid for H1 B workers, that is i must not be paid more than 66K. please explain me.

Above statement is great upto LC Application. DOL doesn't ask for paystub during LC process. Also make sure that offered salary is not too high compare to what you are getting right now. If the difference is $2000-3000, most probably INS wont mind. But if the difference is like $10000 compare to your salary then INS might ask additional information from employer during 140/485. Your attorney or employer might get RFE and that will delay the process.

Hello Mr.Jim i too have the same doubt. In the DOT page it shows the systems analyst in level 2 in portland-vancouer area the prevailing wage is $66,768. pl ans to the foll questions:
1. Is that the employee must be paid higher than this wage that is more than 66768 per annum ?
2. Orlese the employee must be paid less than this?
3. If the employee is paid less than the prevailing wage will the lc will get approved?

Offered Salary higher or equal to $66768/year

NO....Offered salary must be equal to or greater then Prevailing wage

3. If the employee is paid less than the prevailing wage will the lc will get approved?
Most probably employer will get RFE/NOF from DOL for Prevailing wage

Hope this will clear your doubts...........

What do you think of my case?

Hi all viewers!

Does the DOL strictly judge our salaries against the level I and level II only? Isn't there supposed to be something in between to evaluate an employee's wage level?

Like in my case, I'm an industrial engineer currently with two years of work experience and an MS degree. The level I salary is 45K and level II is 73K (it is 83K in a nearby county). I'm making 55K and expecting a small pay raise by the turn of the year. I don't think I have yet reached the qualification of a level II engineer, but I'm definitely not a rookie. What do you guys think? Compared with 73K I still have a long way to go..

By the way, everyone in my group has an MS degree in the field...
