Prevailing Wage factor

My I-140 has been approved and I was preparing to file my I-485. My company has said that it cannot file I-485 since recently we have taken pay cuts and they cannot meet the prevailing wage factor specified by DOL.

What are the chances that my GC could be rejected if the company cannot meet the prevailing wage set by DOL. Is it really an issue at I-485 stage.

My H1B is expiring at the end of 2003 and the company also is under the impression that since my I-140 has been approved, they can get a yearly extension with my H1B is it possible. since my understanding is we can get an extension only if something is pending with INS and not just if something is approved.


Please advise on this....

The GC is for a future position. As long as the company is paying you in accordance with the approved H-1B and the company is willing to certify that they will increase your salary to that which was stated on the LC when your GC is approved you should be OK.
