Hi. My LC has been applied under RIR in Texas (B.S with 3 yrs exp. req.) with SESA in May 2003. Around Oct 2003, TX-SESA informed that sufficient recruitment effort has not taken place and found that prevailing wage is not being met (they quoted $93500 as the prevailing wage for software engr with 3 yrs exp) as I am paid $80000. The lawyer submitted the Radford wage survey and requested that this is the right wage and asked SESA to process the RIR LC under Regular LC as SESA is not satisfied with the recruitment efforts. SESA came back in March 2004 and informed that they are accepting it to be processed under regular LC but they sent the application to Dallas RO for a final determination on prevailing wage (as thay are not satisfied with the survey sent by my attorney). This is my situation and my questions are:
1. What will happen at Dallas RO?
2. Does the RO usually side with SESA or do thay actually look into the state of economy et all to determine the right salary?
3. If RO sides with the SESA and asks the employer to match the prevailing wage and employer does not want to do that, does it mean the LC will be rejected there by jeopardizing my 7th/8th year extensions as well as this LC?
4. Did any one go through this kind of situation? If so, pls. share your thoughts!!
5. I have until end of Aug 2004 for my H1-6 year to complete, company already applied for my 7th year based on pending LC clause(still waiting for the approval). Since this LC is in real Jeopardy, what can I do in this situation?

Thanks
