On 1040NR, there is no such check box. So I wonder if it is
unlawful for INS-defined nonresident to check that box
on 1040 as IRS-defined resident.

Before I got mny green card, I checked that box with
a side note saying "Ignore my YES if only citizen can
check here"
 
The following laws says "Every individual (other than a nonresident alien) whose income tax liability for the taxable
year is $3 or more may designate that $3 shall be paid over
to". Don't know if we should use IRS or INS definition.
But since Title 26 is IRS code. I guess IRS overwrite INS.
Good INS overlooked my tax return during I-485
processing.
