Premium Processing Question, Please help !

My H1B ( case Date : 11-08-02) is still pending with BCIS. They have requested for additional information on Jun 12th. This H1 is from Jan 2003 to Aug 21st 2003.

I have also filed another H1 ( 7th year extension ) from Aug 21st 03 to Aug 21st 04. ( Case Date : 05-20-03)

Can I request Premium processing for the second H1B Visa ? If so, would BCIS process it within 15 days considering the fact the first H1 is still pending ?

Also, would BCIS refund the money ($1000) if they are unable to process the H1 within 15 days ?

Any help/suggestions would be greatly appreciated, I have a planned vacation in July to India and this Visa issue is driving me nuts.

I 824 expedite process

i received a approval notice for my I 129 for change of status. but we filed for cable notice to consulate mumbai. it is a BCIS error and we requested to BCIS for correction but after three months we dont get any reply.now we decided to file an I 824, this is an BCIS error, can we ask for expedite process? BCIS granted or not? because BCIS error is an one of the criteria (fixed by BCIS) for expedite process.red
