I'm American. The father is British. We aren't married. I lived with him in England for several months . I've since returned to America and the questions have come up with what to do. After looking and looking, all I find is information about dual nationality, for the child. I'm after information for the parents. Since the child will be birthed here in America with the father present, do any special laws apply to us? I want for him to be able to come here and stay with his child but I don't even know if that's possible. Since the father is of British descent could I move there with the child and be granted citizenship myself?

Does anyone even know a number I can call with questions about immigration? Anything will help. Thanks.

Sine you are american citizen you can probably get a fiance visa. Check on the USCIS web site.

Good Luck

I am not sure if you are sure what you want to do. First you post two different things that you want to do, and both are totally different.

1. If you want that the father of your child stay here in the US permanently AND you want to MARRY with him, then you can apply for a fiance visa. But he must marry with you within 90 days after the visa is granted. Then after he marries you he can apply for AOS or adjustment of status to permanent residency within the US.

2. If you don't want to marry with him but he wants to live here permanently so he can be here to raise the child with you, then there is no way that you can help around, for family based there is necessary that a legal relationship exist between the petitioner (sponsor) and the beneficiary. Your child is the only family tie with him and the only way is to wait until the child gets 21 years old.

3. If you want to go and live in Britain with your child, I don't know the laws about dual citizenship in Britain and you must check out with the British Consulate in the US or if you are in Britain you can check with the Immigration Directorate there or you can post in a British immigration forum. This is a US immigration forum. The US immigration recognizes children from US citizens abroad, if the child born outside the US but at least one of the parents is a US citizen you should go with the US consulate in Britain so the child get US citizenship through you by birth. About you, the British immigration are quite different from the US, so you must check out over there. I know that in Britain if you want to marry there with a British citizen he must apply for a fiance visa for you, and that is pretty strict since the law change on 2004-2005 about marriages with British citizens.

3. The US and Britain does not grant citizenship by marriage.
