Thanks in advance for reading this thread, and for any comments and advice you might come up with the problems my friend is facing now.
My friend was employed by a firm on a Pre-completion OPT (F1 visa). While still on the pre-completion OPT, he graduated (completed his degree). Meanwhile, he kept working for that firm. Few days back, when his firm was preparing to file H1B for him, it was found that his pre-completion OPT terminated the day he graduated. It's been 43 days since he graduated, so he is still under the 60-days window, which, I think, means that he can still legally stay in the US for the next 17 days; but he has worked illegally (although, unintentionally) for over a month (he resigned from the job the moment he knew that it was illegal to work). Now my questions are:
1. What should he do? What are the charges or penalties he might face for working illegally? Is there any ways he can appeal?
2. Can he apply for a Post-completion OPT? Is there any chances that it might get approved?
I tried to make his situation as clear as possible. Please let me know if I did not.
