Pre Approved Labor

Hi,

I have a situation on hand. I have got my labor(PERM) and I140(EB2) approved from company A with PD of Jul, 2005. I haven't applied for I485 obviously due to retrogression.
Now I got an offer from a big company B(not consulting) who is offering me a job with pre approved labor for EB2 with PD of Mar, 2002. I was confused that will there be any problem in going ahead with company B with Substituted labor and filing I140. The education qualification and work experience matches.

I had worked with company B from 2001 to 2005 and then moved to company A. So Company B is willing to provide me all relevant experience letters etc.

Any suggestions/comments are most welcome.

thanks

If I am in your shoe, I will opt for it.
The reason is the PD of the current labor that you have is 2005 and for it to become current you need to wait for the next 3-4 years.
And moreover you have worked for that company and it is always being an advanatage of taking it and I see so many approvals earlier in labor substititution and succeed.
I would rather suggest you to discuss with an Immigration attorney never mind for 100 bucks this will turn your future.

Thanks Dallasking, yes you are right and I have taken this option. Lets see what happens.
