Practical Training Delayed over 6 months ! Please Help

i have been waiting for a 6 months for my OPT.I couldn't get it until now.I tried to get temporary EAD from INS office Dallas.But I was told that I was denied EAD on Sept 17th.But when I called the TSC at Mesquite they told me it is still in process.I dont know what is happening in there.I lost an job offer becose of this.If anyone can give me a suggestion it would be nice.Will my OPT get reduced?Can I sue INS for the delay?Am I out-of-status?

It is very likely that you would lose the OPT time until you get the EAD card. If you are lucky they might have a start date that coincides the approval date; so you might have more OPT time left at the end (you may have to reapply to get the additional time).

Not advisable to sue the INS, sorry. But you can hire a lawyer to prepare a course of action. You are in valid status until the INS adjudicates your application. Another option is for a propsective employer to file for a H1 through premium processing.
