Potential Pitfalls

Lacklustre

New Member
I am a US permanent Resident and have been for 10 years, although i was divorced two years ago. I have been dating a Canadian for a while now and travelling back and forth from Ohio to see her for a week or so at a time.

I have been lucky enough to get promoted to a position where i can work from home. My intent is to split my time between the US and Canada, slanted more to living in Toronto. Where do i stand from the point of view of safeguarding my US residency. Is coming back for a week every 5 or 6 weeks good enough or will they consider that abandoning my residency? I am prepared to rent a room in order to maintain a US address. What other potential problems does this approach entail? I believe i am safe working in Canada as I am not actually employed by a Canadian company, nor depriving a Canadian of a job

Any advice would be gratefully received

The CBP agents will have all your entry dates, and they will ask you how long each of your "trip" was. They may become very suspicious if you are entering USA every 6 weeks after 4-5 weeks staying in Canada. They can take away your GC and send you to see an immigration judge.

Also, do not forget about Canadian guards. They will not let you in unless the purpose of your trip is tourism or business. If they suspect you spend more time in Canada than the USA, they will turn you around. Then, you will be referred to the secondary inspection on the US side and will have to explain to them why Canadians turned you away. It may also result in taking away your GC.

So, I would suggest you to not live in Canada while you are on the GC.
