Posting for my friend, AGAIN, please help

A friend of mine applied for I-485 in October 2000 and got the FP notice in November 2000 with a deadline of Feb. 01 (normally as you guys know, if we don\'t give the finger prints, the petition will be denied and the letter said so). For some personal issues he could not do the finger prints. He did not correspond with INS so far and neither the INS with him (so, he did not receive the intent to deny or anything). The question to the group is: can he request the INS to schedule him again for the finger printing? Thanks-a-bunch.

The INS considers this , most definitely, as "Case Abandoned". This may several other implications such "I485" refiling and if so your friend will lose the processing time. I just couldn\'t help but comment that I am just amazed at your friend\'s carelessness and there may a huge price to pay for this... INS creates headaches for people who file everything properly, so you can imagine... Normally nobody would respond to this post because nobody will come even close to this situation...

I agree with Bhanu on this. But I have an other thought on this. Since the I-485 application has a ND of Oct 2000 and since the VSC is processing applications submitted in Mar/Apr 2000, I think your friend will not lose anything by going to the FP center and try to get the FP done.

I do not know, how the INS service center (doing the FP) will react to this situation. But it is worth a try.

Thank you so much for your response. It is not "Carelesness", there was a situation beyond his control and he had to go to India for an extended period of time.

Hello, there\'s always a provision that you can goto FP much earlier than scheduled date. Atleast one should notify INS that FP cannot be taken and get a rescheduled appointment that one can make it. Being proactive is one way we can encounter possible INS delays. It was just a thought and I apologize if I offended you or your friend by using that word. However, the act still would amounts to taking things lightly and not being proactive. I would suggest contacting INS right away by writing a letter pleaing for reconsideration.

The ASC place I went to get my FP done was practically empty, they were waiting for someone to come in. Given that I am sure your friend can walk into an ASC with the FP notice letter and get his FP done. the worse, he\'ll get sent back. Good news would be if he doesn\'t, and his FP\'s are taken, later he can check by calling IIO how his FP prints came.
