I am on F1 now and pursuing PhD degree. I have been offered a postdoc position and they will sponsor an H1B for me. For some reasons I cannot change my status to J1 or OPT. The employer is planning on filing H1B for me but I was wondering if the application will be approved because I have not been awarded my PhD degree yet. Do I need to get my PhD before filing H1B for a postdoc?

you should talk to your institution's international office/attorney. However, for H1, I think only requirement is that the job ad needs to be mention a specific field of study. For instance, if it mentions just Bachelor's Degree, it is not ok. It has to say Bachelor's in Mathematics.

So if the post doc position specifically requires already Ph.D awarded then H1b might not be possible. Sometime some of these positions are ok with ABD. Again, I would talk to a attorney.

Good luck and hope things work out for you.
