My case was initially randomly audited in Nov 2005(not business necessity) and we sent all the documentation. However they said that since we failed to provide original signatures the case was denied (this was not true as we had sent the signatures). We sent in a motion to reconsider.
After being denied our motion to reconsider (June 12, 2006), my lawyer has advised to refile instead of appealing to BALCA. (While he was away on vacation another lawyer in his company advised to send it to BALCA so now we have to withdraw but that is another story!)
The attorney is considering changing my job title to something else in case that was the trigger for the audit by the system. My past job title was "Educational training coordinator" and the job title applied for was "instructional coordinator"
1) Has anyone had success in refiling after being audited and receiving a denial?
2) Has anyone ever tried to change the job title when refiling?
I am very close to starting my 6th year of H1B. Any input is appreciated! I have learned so much from this forum already. Thank you!
