I'm on an H-4 visa and my father got his labor certiifcation approved. My father was born in India and he is going to file for his I-140 soon. Our lawyer told us that even after the I-140 is approved , we would have to wait for a visa number to be availablle to file for I-485. So in that case, if we get an approved I-140, do u thikn my father could apply for an I-485 for me because a visa number should be available for Kuwait born people?
