Possible to File multiple I-485?

Hi Guys,

I've a very complicate situation here. My previous employer agrees to continue my I-485 sponsorship even though I do not work for them. I filed the I-485 to NSC last year with RD 8/22/2001, in the mean time, through my current employer, I've got LC and I-140 approved based on the sponsorship with my current employer. LC approved on 03/10/02 and I-140 (TSC) approved on 08/29/02. I heard that one person can only have one adjust to permanent residence status pending. So I am stuck here.

I'm just wondering what's my best shot, shall I continue with my current employer's I-485, which means I might have to withdraw the I-485 from my previous employer, or I have to wait until there is reponse (whatever) from my previous I-485 application.

My current employer is not stable these days. There might be a take over, or close down in the coming 3 months.

Thanks a lot

paralel filiing is possible

I am not sure if you can have two 485 pending at same time. But I heard that one person have EB1 and EB2 cases filed simoutaniously. Maybe possible.
From what you posted, it may be silly to withdraw your one year old 485 case from NSC. it's almost done. 485 is intended for future employment. You'd better to wait for that. Also, the 180 portability thing is very important now in this weak economy. You'd better not to withdraw that.
You may need to consult with experienced lawyer or others if you want to file your 485 with current employer.

Thanks

Thanks a lot for the reply. Definitely I'm going to wait for the I485 that is due very soon.

Assuming that the prior I-485 was validly filed (you had a job offer from the sponsoring company) I would continue with the old I-485. You cannot file with the new company while the old I-485 is pending though. You should have portability at this point so as long as the new position is "similar" I see no reason to dump it and refile.
