Possible rejection of EAD renewals filed too early

News alert (unconfirmed): According to the Oh Law Firm, AILA has received notice that USCIS will refuse I-765 applications for EAD renewal filed more than 120 days before the expiration of the old one:

"AILA has reported that it received a notice from the USCIS that any EAD renewal application which were received on or after 01/29/2008 that was filed more than 120 days from the date of expiration would be "denied" for filing too early. We need clarification, though, as to whether the consequences will be "denial" rather than "rejection." Considering the fact that the filing fee is expensive, if it is denial, the filers will lose the filing fees paid. Please stay tuned for the clarification."

One should wait until other law firms confirm this, but just thought I'd let folks here know.
 
120 days or 180 days. They have on thier website that renewals should be applied at least 6 months from the date of expiration.

Their website it is just a mees ....no updates ...no clear info....just confusing for everybody !!! That's another proof of how messed up they are ...
I've allways told everybody ....DO IT ( renewal ) with 120 days before expiration of old one , to be on safe side !!! That will cover any RFE's received ( if any , wich will delay process ) , and keep you on 90 days time frame also !!!;)
 
Well I filed 150 days in advance. They cashed my checks and did my BIo's. Havent sent my approval for EAD's yet but that is another story.
So I dont know if they are denying applications filed on or before 120 days.

Yes , you should be OK , because you did apply before 01/29/08 !!! Your application it going to be process normal , and i hope ... on real time also !!! Good luck !!!;)
 
I just came to know that I should renew my EAD 120 days before my current EAD expiration, but I mailed my renewal application yesterday 130 days before the expiration. This news was just released today. Do you guys think I'll lose $340 or CIS simply rejects/returns my application.
 
I didn't post this story to start a panic!! I just saw it and thought it might be interesting. That website has a lot of good info but I wouldn't trust it 100% until I see it somewhere else as well.

Employment Authorization

USCIS issues Employment Authorization Documents (EAD) in the following categories:

EAD: This document proves you are allowed to work in the United States.
Renewal EAD: You should apply for a renewal EAD 120 days before your original EAD expires.
Replacement EAD: This document replaces a lost, stolen, or mutilated EAD. A replacement EAD also replaces an EAD that was issued with incorrect information, such as a misspelled name.
