Possible Issue with Company Name Change

Here is the deal. I just received an RFE to provide an employer letter. I work for company X. Alwyas have. Used it for my LC, I-140, 485 etc.

Comapany X belonged to a group of companies. For example Kraft foods and Miller brewing are a part of the Philip Morris family. Assume I work for Kraft. Now Kraft shifts and becomes its own company or lets say it joins some other conglomerate. Is this an issue? Since I would still be with Kraft.

Guess I am rambling, but the point is that my companies letterhead has changed a little to reflect the change in the group of companies and the logo has changed. However, my company (the one I am employed by) and its work, its federal id, and its name remain the same.

Could I get a I-140 redo?

I am very much sure that you will get 2nd RFE in this case. So, in my honest opinon while responding to the current RFE you may want to file petition to amend 140. Once you have notice receipt you can send this receipt along with your 2nd RFE. This will minimise your response time at the time if you have to respond to 2nd RFE.

There are many in this board who filed thier 140 ahead of RFE. I hope you do not get 2nd RFE. But the way things are going mojority are receiving to redo 140.

The problem I have is that what am I to do in the petition to ammend the 140? The new 140 will be the same as the previous one as the company I work for will be the same as before. The first 140 had no reference to the parent company, as I never worked for it. The second will have none either. So the 140 will be exactly the same. Its just that the letterhead looks different and says group A instead of Group B. This way too lame...

I think it will depend on whether or not X is a corporation that is a wholly owned subsidiary of the conglomerate, or if it is just a division that is managed independently. In the former case, I don\'t believe you will have to deal with an I-140 redo, becuase all your paperwork should reflect X as the employer, and as far as INS is concerned they really don\'t even know or care about the change in X\'s ownership situation. In the latter case, however, you may get an I-140 redo RFE, and I think even that is up in the air right now, given the new law.

Well it is wholly owned subsidiary. Will see what happens. Will really suck if they ask for a redo cause the redo will be exactly the same application as the original 140. But I would have wasted more time.
