Hi all, I seriously need your help......
Here is my immigration story:
* Labor Approved = Jan 2001.
* I-140 approved = Aug 2001.
* Applied for I-485 = Receipt Dt = Oct 2001, Notice Dt: Nov 2001.
* Applied for 1st EAD = Notice Dt = Nov 2001.
* Finger Print date = Jan 2002.
* Changed Employer based on AC21 in March 2004 - till date.
* Case filed in TSC and transfered to VSC (due to company 'A' exists in boston).
EAD History:
===========
1st EAD start_Dt and End_dt = Dec 2001 – Dec 2002.
2nd EAD start_Dt and End_dt = Apr 2003 – Apr 2004.
3rd EAD start_Dt and End_dt = Apr 2004 – Apr 2005.
Recently, my company's lawyer & desi H-1 company received a letter from INS stating possible revocation of I-140 as the salary stated in my labor (54000)
& W-2 (26000) does not match in year 2001 due to bad economy, Now INS is raising question looking that year's W-2 saying that it is a fraud case on company.
My desi company's lawyer has to reply within 30 days.
I had a personal inteview in 2002 & that's how INS has my W-2.
My company 'A' used to pay me only when I was on projects & that was the only year when I din't had my job for 6 months.Recently this year I
joined a new company based on AC21 & I am working with same title & more salary.
My EAD also expires in April 2005 & I wonder if they would reissue me or not, My H1 had expired long back and I am working on EAD.
My questions are is there anything else I can do from my side or just wait until INS sents out any letter to me.
If they revoke my I-140, what options I have rather than go back to India ??
