Possible Denial Help

My husband and I have been together for 3 years, and got married this year. We had our adjustment of status interview earlier this week. I was born in the U.S., our relationship is real, and we have tons of evidence proving our marriage is real. However, my husband was married before and applied and was denied residency over 10 years ago due to not having enough evidence- he and his wife broke up shortly after. I am worried because our interview was going very well, and at the last minute we were told our application couldn't be approved due to the officer needing to look over my husbands last case. He told us we may be okay, but that our petition could also be denied based on his past application. As a U.S. Citizen should 't I have the right to have my husband in my country with me? Does USCIS have grounds to look over a case closed 10 years ago that has nothing to do with our case now? There was never any kind of deportation order for him. Help! I am worried about what could happen and what I can do.

They have rights to look of course. From their eyes it might seem he keeps getting married to get immigration benefits only. A previous incomplete case, especially giving up after not having enough evidence is suspicious.
But as long as you are really married and you stick together, he would get approved. In the worst scenario they would ask for more evidence, or intend to deny but you can fight that and meanwhile you would have more evidence.
