Today, I received approval notice email for my EB1-OR after more than 6 months of waiting. I have a son who will be 21 on June 22, 2007. Of course, I do not want to waste any time on preparing I-485 application, as anyone in my situation would. Fortunately, I am not from a retrogression country. Could you please tell me what is the best way to address the age-out issues? Any tip on I-485 application would be greatly appreciated! In another thread, eb1doc provided me with the check lists for packaging application materials. The check lists will be my starting points, I believe.
Probably, my journey for the green card quest has been unlike any of yours here so far. My employer first filed special handling labor certification (for college/university teacher) application in November 2002. Looking back, I must have taken a wrong path. That is, I thought special handling is the easiest option for me under the circumstances. Naively, I believed that I would get the certification within a year at most. Besides, I thought EB1 is reserved only for the Novel laureates and such.
I was wrong, wrong, wrong. Nothing happened for more than a year and a half. Finally, in July of 2004, the Dept of Labor San Francisco Office sent a Notice of Findings that “Employer failed to provide adequate notice of the job opportunity.” My employer submitted a rebuttal in a timely manner. No word from the Dept of Labor for a few months! Numerous telephone inquiries revealed that the application was remanded to the State of California at some point. Then, I managed to speak to a lady at California EDD in January 2005 and found that the application was sent to the Dallas Backlog Center. Can you believe that there had been no word (formal notice) from Dept of Labor whatsoever between the Notice of Findings in July 2004 and “45 Day Letter” in March 2006?
In the meantime, I decided to venture into EB1 in a desperation in the second half of last year. As the information in my signature indicates, my application was received at CSC on 11/04/05 and receipt notice was sent on 11/09/05. On March 22, I received email notice of the case transfer to TSC on 3/21/06. It was only yesterday that I received another email notice that the transferred application was received on 3/29/05. This morning, five email messages of the identical approval notice were waited for me.
Thanks a lot for reading my silly story. I know how to wait in the immigration game. This time, however, I hate to wait another three and half years, let alone my son will turn 21 in June next year. Please share your wisdom on dealing with age-out issues, etc.!
