Possibilities of Retaliation by FBI/USCIS

As they have to accept 485 applications against their initial plan..
Is there a possibility of retaliation by any of following means:
1) By delaying
2) Following everything according to book..No leniency.
3) Very conservative VISA bulletins.
4) Delay is namecheck etc..

any thoughts?
 
USCIS is so disorganized that they took all the abuse and then reversed the bulletin. R u kidding me! You need to be on top of them if in case u see any retaliation. I do suspect back to inefficient processing like before.

You can't stop them from following a rule to a word...It is hard to be on top of them, Rarely of any use unless it is more of a class action.
You will also rarely be able to enlist a lawyer to go after them, Immigration lawyer tries to be very cozy with USCIS.

You are right about lawyers being very cozy with USCIS. Rajeeev Khanna was so much against the idea of AILF case and how USCIS would win it....S Murthy suported the AILF case. We will get a lawyer to take the other side.
We may need to come together for all this and raise objections rather than accepting things....
 
USCIS set a record of approving 60,000 I-485 applications in 30 days and they may retilate and set a record by approving only 6 cases in 30 days
 
It will take months to get a receipt notice for anything related to an I-485 application filed between this month and August.

Then there will be ultramassive retrogression in October. They will set the dates so far back that nobody in EB3 anything or EB2 India/China can apply, unless their priority date is before the Civil War. But despite doing that and accepting very few new filings, they would still already have enough pending cases to use up all of next year's (and the next 4 years) quota. Only Congress can provide relief, by recapturing the 180K+ unused visa numbers or and/or exempting dependents from the quota.

The July approvals show that they didn't actually approve 60K in a month. Maybe they approved 30K-40K in June, then continued to do more approvals in July.

:) from what I heard they are planning to add a AD/BC to the dates. So EB3 India is expected to go to 1050 B.C. and EB2 India around 500 B.C.

6 months time for checks

why dont we be thankful for once at least. At least thousands will be able to apply for EAD.

Correct me if I am wrong. USCIS should cash the checks within 6 months other wise the checks will be void. As per rule after getting the receipt date count 90 days and 91 st day we can request for interim EAD if we did not get an EAD by then.

Or is there a rule we are now come under 485 pending status even though we do not have receipt date and we can request for EAD in the month of October ?:confused:

That won't happen, because the average processing time at Ellis Island was less than a day. No way they'll ever be processing people that fast again.

If your checks are cleared, you possibly dont have to wait until you get receipts by mail. View the back side of your check if you are banking electronically and the case receipt number is usually stamped at the back.

USCIS has got rid of the biggest stumbling block "The Labor Substitution" Rule.
Unless anything else funny comes around (like reducing the number of Visa Numbers per year, or the name check fiasco) I dont see any further delays.

Just forget about this for now, get your EAD, get your fingerprinting done and start preparing for what you will be doing in 2009 with the GC, some even in 2008.

nice and optimistic. But on what basis??? All the numbers that people have put forth so far for number of people who are applying make things look really bleak for people from oversubscribed countries (India/China). Ballpark numbers thrown around so far are: 400K applications, 30% of those are Indians, so 120K Indians. country-limit of 10K, thats 12 years...

What is the reason for your optimism?
