What are my options?
Hi
I am a software engineer from India and my 6th year of H1B is about to end soon – May’09. My employer is filing for the green card – EB2. The LCA was approved in July’ 08 and plans to file I-140 soon and hopes to use the premium processing option to get the I140 approved prior to the expiration of H1B and apply for a 3 year H1 B extension.
My questions are
1. Can I switch the employment on the H1 B after the extension (upon approval of I140)?
2. Given the current back log and the time it takes to process I40 – how many months can I estimate before I 485 can be filed? 1 year after I140 is approved or more? or less?
3. Does filing of I-485 automatically process my EAD? Is it a possibility that the employer gets the I485 filed without filing the EAD or Travel authorization?
4. How long after I 485 is filed can I switch my job? Can I change my profession?
I will appreciate any advice to my queries above, as I am planning to invest in an MBA, and am trying to ensure the degree at this time does not end up in waste of time and money.
Thanks
