portability (Do we have a final rule on this yet !!!!!!)

Do we have any final news on portability issue. I am filing concurrently in this week but am quite concerned about portability rule (in case my employer lays me off).

Secondly how long does it take to get approval for AP and EAD.

All adivce from gurus would be deeply appreciated.

Why are you waiting?? File concurrently. Portability rule always exists. For concurrent filing the worst case that might happen is that 180 days will be counted after I-140 get approved. Also INS is approving I-140 for concurrent filing within two months. Some people already got it within two months.

Either way, you will win if you file concurrently. If already spent some days thinking, dont spend anymore.

Don't waste too much time in thinking, File Concurrently ASAP.

Go through portability thread in I-485 issue or
Go through thread started by wxm8 for concurrent filing.

There is no truth in that rumor, As far as my lawyer and other mention. (That ' portability doesn't exist when you file concurrently ')

It's true there is not final ruling yet, but it won't be there for months, (same like Ac21, after long time INS never answer if 180 days count from RD or ND, but most lawyer says RD)

My lawyer told me that he will file on Monday morning. My only concern was that I had a trip coming up to Canada next April and I would like to get AP by then. Hopefully I will get it by then.

But I heard that for concurrent filing the AP and EAD might be delayed.

I hope INS finalizes the rules so that all this speculations ends.

You need to get I-140 approved to get AP an EAD. You can go to local INS with I-140 approved and get it quick. Its your choice.
To go to canada and come back, you dont need any visa or AP if u come back within 30 days assuming you have valid status.
