Poor Moral Character!

UCIS denied my citizenship based on "poor moral character"
i applied under the 3 year rule (marriage) my interview was scheduled for the mount laurel office in NJ april 25 2008. i was so naive and stupid that i went to the interview with a pennsylvania DL instead of a NJ DL. the reason i had a PA DL was that my wife and I rented a house in PA in 2005 as an opportunity to buy it down the road i also registered for classes in a PA University. the deal was never made but instead we bought a house in NJ in 2006. while we remoled this house we stayed between her parents house (where i received my important mail) and PA. the inmigration officer claims that i was trying to claim in-state tuition in PA and was the reason she denied my application. i have been paying property taxes in NJ since 2006, we paid our income taxes, my bills are mailed to this address but still they believe i was lying and therefore they denied my application. in september 2009 i reapply for another interview this time i will go with a lawyer as i find this very unfair i will also bring my wife so they can see our marriage is real and legal. my interviewed has been scheduled for dec 7th. its been more than 12 month since i "legally" moved to NJ. based on your experience you think they will denied my case again?.....we paid taxes jointly, i never committed a crime or arrested, no DUI, no kids, never received state aid. my lawyer recommend that we dispute this with a lease that i have from those years...i don't know how valid can this lease be?.......i decided to fight in this case....guys please wish me luck!

Well, did you claim in-state tuition at the university in PA? If you didn't, did you tell the officer you didn't, and asked the officer to allow you to submit your tuition bills as proof that you were paying out-of-state tuition? Or is it that you only found out the reason for denial in the mail?

In September 2009 when you reapplied, you would have completed at least 4 and a half years of being a permanent resident. If you completed 5 years minus 90 days when you reapplied, at the interview you can ask the application to be changed to the 5-year option*. That way your marriage won't be scrutinized much (if at all); the focus will be on your continuous residence and moral character.


*unless you have criminal issues or extensive travel more than 3 years ago, and therefore want to stay with the 3-year option so those issues will be outside the statutory period.
