Dear Dr. Poon,
I need you opinion. I have followed you closely and I admire your insights.Please help me here.

My Case:
I am the primary applicant (EB2). I applied for my wife at the same time when I filed my 485 in May 2001.

I checked the case status today and it says an RFE has been sent on my wife's case (on 12/9). Meanwhile, my case status remains unchanged (FP RECEIVED).

Is it possible that they have overlooked my case?
If they looked at my case...Why did they not just approve my case separately since mine was based on an employment offer (as primary applicant).
Is it possible that they want to consider the 2 cases together?
Is this a good sign?

From your post I understand that you and your wife have applied separately - you applied as primary applicant and she applied on her own based on your I-485 filing.

If this is the case most likely your files are not bundled together. I doubt that TSC has improved its internal storage nightmare and it will be very difficult for them to match related cases.

Postings on this forum in the past have indicated that there have been isolated cases of approvals of the dependent before the primary applicant. This has been just another sign of the chaotic TSC processing culture. If this happens you might be having some trouble going through the current communication black hole and voicing your concern.

However, the good news is that someone is looking at your wife's file. Use the response to your wife's RFE as the perfect opportunity to hint the adjudicating officer to get your file as well and process both applications together - include detailed information of your case as the primary applicant (A#, SRC#, RD, ND, FP date etc.)

Thanks for your accolades, even though am not sure if I deserve them. Anyways, I partly wish to concur with gingibi where only one or two instances have been reported with the derivative getting adjudicated before the primary. That much said, I still do not see why you would want RFE to be issued to both. For ex: it could have been an instance where they may need your wife's Birth Certificate and not yours. Or, may be they are asking her medical report once again. Or, they are asking for the marriage certificate and/or your underlying I-140. So, I will certainly not get panicked. Chances are pretty high that her RFE may trigger your approval as well.

Unless your wife processed her own I-485 through her own I-140, both of your cases will be treated together only. The A# file generating system of INS will always try to associate the A# to the underlying I-140. So, even if both of you would have applied at different points of time and not together, the I-140 bondage would assert the matrimonial bondage between both of you.

So, nothing to worry, dude. :)
