yes, you have to file within a year of arrival to the us. but there have been cases when people file later if situation in their country has deteriorated since they've been here in the US. The basis for the asylum is that you fear with your life that if you go back, you may be killed or discriminated against. You can't just say I don't like it in my country or I don't make enough or whatever....
