Police Clearance Certificate Error due to Passport

I got my PCC from NY Embassy last week. Unfortunately, I realized that my father's name shows up as my surname (last name) in my passport which was issued in Dec 1995. Due to this error made by passport office from india, PCC is issued with name as it appears in my passport which shows my fathers name as last name and given names from passport as my first name followed by my actual last name.

NY Embassy has refused to rectify this name problem in passport and PCC. I checked with passport office in india and they said that I need to be present in india and only then can they do the name change in passport. I cannot mail my passport from usa.

I am expecting Sept/ Oct 03 CP interview.

Any suggestions? Woudl this pose a problem during CP?

This is strange. Have you not realized the mistake in your name
in the passport all these years?

How is the name in the US documents like H1B approvals and
the Visa stamps in the passport ?

If the name in the passport is wrong they you should get it changed irrespective of it's impact on the GC process.

The Consulate General's offices in US do entertain requests for
change of names but the process is long. Here is what it says
in CGI, San Francisco home page:

What are the requirements/ documents to be submitted?

i) Completed application form for new passport

ii) Original existing passport

iii) 4 photographs (preferably in colour, front facing, 35 X 45 mm )

iv) Court Order or Sworn affidavit in the prescribed form – Affidavit for Change of Name , giving both names, duly notarized by a Notary Public.

v) Original newspaper clippings of the Notice for change of name in the city of domicile in USA AND in India (2 notices-one local and the other in India).

vi) Copy of Green Card (both sides, enlarged clear copy) or Employment Authorization card (clear enlarged copy) or legal/ visa status such as HIB etc.

vii) Fees of $ 20 for new passport

viii) Mail back charges (preferably $15 for return by overnight mail which is more reliable and safe. Consulate can not take responsibility for delay in receipt or loss of documents sent by certified mail. No self addressed envelope necessary. Fees for passport + mailing charges can be sent together through a single money order or cashier’s check. Please note that payments by mail can only be made through money order or cashier's check in favor of the Consulate General of India.

Thanks Raju for the quick response. Yes, until last week I did not realize that there was such an issue. Until I called NY Embassy that they had my name mispelt in PCC and then they told me thats the way it is in my passport.

Answer: Issue is only in my passport. All visas F-1, H-1 along with visa extension papers have correct first, middle and last name. I have birth certificate and affidavits of birth that i got for my CP interview to prove the correct name.

REquirements:
I can take care off these i, ii, iii, vi, vii & viii requirements.

Answer: I have sent an email to NY Embassy to find out if i need this since this is really not a name change.

And as unfortunate as it can be the email box for NY Embassy has been clogged. Emails are bouncing. So I will now need to find another email id fo NY EMbassy.

As Raju595 says, it will be better if you do correct your passport details.

Long back, I have heard a case that got into problem due to Middlename and Last Name problem.

I don't know how he resolved it though.

I talked to my attorneys and they suggested apply for a new passport with a request to change name (which involves getting a name change affidavit and name change advt in Local news papers and newspaper in india.) This will show diligence on my part to rectify the error. Hopefully I get the new passport before my CP Interview, if not the attorney said use birth certificate, affidavits of birth, school certificate as proof of my name and the consular officer cannot reject this. I just thought of posting this update so that if other have the same issue they know how to resolve it. So as next step I will be placing add in newspapers since i already got the affidavit notarized.
