My point is after crossing several months of GC approval, one guy got NOIR. According to me he is in a better place. Atleast he used AC21. I neither used AC21 nor worked with my sponsoring company after my GC approval.

I am wondering what will happen to me?

I guess INS will not allow me to sleep one night peacefully.

Just sharing persoal opinion not necessary all would agree with,

First thing First, 'No One is Perfect except God'

in that article even author clearly said, they believe this is isolated case, no need to panic.

USCIS knows many things but, keeping their slience on many things.

As a friend I like to say that, I have seen ppl who see others who have any disease/illness/or problems, and start comparing about chances, and soon they see symptons they start panicing and belivieng that are in same situation, becasue they always believe that they have more chances than other who got this.(telling u very truth) it happens and I have seen ppl. reason!!!???? pessimistic way of thinking.

Your worst fear come true if u start believing on somthing un-fortune.

Always think positive and be hopeful. practice ur faith, Strong un-shakeable trust on God (whatever u believe on).

Don't panic, Relax and follow your gut instincts, and not to panic by comparing others mis-fortunate.

First step Change ur nick 'Un-fort' to Mr, Fortunate :D

Second, start thinking this was isolated case, and plz do sleep well.

Third, listen and follow your gut instincts, and take necessary steps.

Always Be hopeful, Trust on God(whatever u blieve) and pray(according ur believes), be fearless, but kind, good with ppl, generious, and be happy who you are, whatever u are and where u are. in all situation, and leave everything on God(whatever u believe), Nothing will happen everyting will be fine. :D

Good Luck

Hi POJ,

I agree fully with your 4 golden tips.

But, the risks only drives me crazy...

Had i been in H1B and INS kicks me.....i will drive my (1996 made) car to the airport and say bye to US.

But, after GC, If i have to leave all the sudden i will loose heavily due to so many commitments (wife using EAD for her higher studies...investments...etc..).

So, why should not INS make it clear before issuing GC. Once GC is issued....leave them (Residents) free.

This is an isolated case and there is no need to panic.

You recently got approved so enjoy your PR status and sleep well.

:) :)

The use of AC21 entails informing INS of the change of employer. If someone does not do this, then it is the same as being unemployed.

Raju Badmash:

Can you please provide some details about what are the bases for your statement. I have read some about AC21 but I have not came accross to anything requiring the applicant to inform USCIS about change of employment.

Respectfully,

>> But, the risks only drives me crazy...

Understand completly, you are not worry about yourslef. and u are not alone is this fear. :D

Tell me, What is not in risk? :D just take a look around yourself can u give any guarantee that everything will be same forever? noone knows tommorow :D, we all trust on God and hope for good things whatever is written in our luck will come in front.

>> But, after GC, bought a house for $400K, two brand new cars....children
>> education....If i have to leave all the sudden i will loose heavily.

That I call 'trust on God(whatever u believe)'. Believe on your Luck. If God wish you to grant and keep these temporary things around you, it would be there , if God decide not to(your fear) noone change what is written in your Luck :D. Be very brave my friend, do you see anyting will everlasting here?.

All we live on trust of God whatever he wish for us and grant us or or take it away. there would be some good reason and we don't know on that time.

>> So, why should not INS make clear before issuing GC. Once GC
>> issued....leave them free.

In many things by Law they won't, read more murthy articles, in many issues they would only verbally talk or give unclear explainations. I believe its 'Policy' :D , to keep u in fear and live with uncertainty.

Good Luck

Question 10 : How do I exercise the portability provisions? What do I actually have to do? TOP

AC21 does not state that notification to INS is required. The current INS guidance on the issue says that it is "expected" that a letter will be sent to INS. There is also no particular format for sending a letter advising of the change in jobs.

My opinion about AC21

I agree with POJ, and this is just to share what happened in my case....

In January 2003 when I was laid off from my sponsor company, I called my lawyer asking about guidelines to define "same or similar job" under AC21; and her response was: "do not worry about that at this time, just get a job and then we CAN find the way to justify the change and FILE AC21".

After some time I got a very similar job (I do not thing it can get closer to my LC description) and I just notify my lawyer. I did not request her to file any notification with USCIS since I thought and I still strongly think, that filing any AC21 paperwork is just another way for the lawyer to pull additional money out of our pocket, and is a symptom of a sick paranoia.

By the way, paranoia is a vicious fear, and therefore is a sin that evidences the lack of faith in our Lord. Nothing is granted in this world, we are just administrators of what our Lord is providing; lets keep faith in Him and we can honor Him.

This is my humble opinion
