Hello,
First of all, thanks a lot for this great site and everyone's time and support.
My & my spouse's application for AOS (Adjustment of status) I-485 was filed with CIS - Vermot center on Apr7, 2004 concurrently with I-140 by my employer, after I140 got approved in Aug04, 2004 , we had our finger printing done in Nov 2004 which per CIS has been verified and send back by FBI in a week.
However I have not received any news so far on my I-485 approvals. On raising constant queries with CIS, the Vermont Service Center send me a letter on June1, 2005 stating "The processing of your application requires routine Security checks that are resulting in delays of applications. As a result of the lack of manpower to complete checks in timely manner, we have no control over how long it will take, we can give no definite indication of when it will be completed, apologize for delay".
Based on feedbacks from this and other immigration discussion forums I have done/am in process of doing following
1. Called the FBI helpdesk and have send bunch of emails to 'FBINNCP@ic.fbi.gov' in last 6 months with no response so far.
2. Have send a PRIVACY ACT request (FOPIA) few days back awaiting response back.
3. I am also planning to talk to my State Senator rgd this.
Can anyone please advise on the steps to be followed to expeditite this pending FBI security check since NOV 2004. Also not sure if it's same as NAME CHECK ? One more question - considering this delays, would it make sense for me to go through Consular processing in INDIA ?
Would greatly appreciate quick response. Thanks a lot !!
Jayesh
