Here's the situation, thank you very much~

A friend of mine worked off-campus for 2-3 months on his SSN without authorization last year. Then he realized it was a bad idea and stopped. He is on an F1 visa. Now he is going to file his tax return. What form should he use? 1040 or 1040NR? Should he file as an F1 student or any other visa type? He is very worried about being caught... Anybody here has similar experience? Any help is appreciated! :)

Listen, the only thing he/she should worry about is what will happen if he keeps working illegally. USCIS takes this very seriosly. However he has already work and all he needs to do is include that in his or her income tax return.
Yes, when he files for change of status in the future, he will be asked, if has ever worked without authorization and then he has to answer "YES", the reason is that they will ask him for a tax transcript, so they do have that information already.
Most times this will be forgiven, and seeing in his case it was just 3 months, he can just explain he was not aware of the law.
But yes, tell him or her to do the right thing, File, and make sure to say "yes" when he decides to apply for permanent residence..etc.

If you need any more info, you can send me a Private message.
