my H1-B expired on feb 2012, but i was using EAD and wife also got her EAD on 2011 , but when we went for renewal they rejected her EAD saying her I-485 was rejected , the reason was the priority date was not current when we applied her 1-485,EAD,AP so they rejected her I-485, unfortunately we and our lawyer never got the letter, it looks like they rejected her 1-485 on JUNE 23 2012 , only after we got the ead/ap rejected letter we came to know about the 1-485 rejection,that was on oct 2012 , so wife left the country on nov 26 2012 , now i have got a new H1-B approved, i am going to india for my stamping, the rules says if she stayed in US for more than 180 days there will be a automatic 3 year re-entry ban, so i am worried is this 180 days period starts from the day 1-485 got rejected or from the day my H1-B expired.please this very urgent i will appreciate if some one can clarify this questions.thanks in advance
